A divorce or a separation often turns several parts of life upside down at the same time: the children, the home, the finances, the organisation of daily life and the future. In these moments of tension or uncertainty, it is essential to understand your rights, to identify the possible choices and to build a strategy suited to your situation. I work with you at every stage, whether the separation can be organised through an agreement approved in a consent judgment, or whether contentious proceedings before the Family Court prove necessary.

Two routes are possible: organising the separation through a complete agreement, or asking the court to find that the marriage bond has irretrievably broken down.
Belgian law provides for two types of divorce. Divorce by mutual consent requires the spouses to agree on all the consequences of their separation: the children, maintenance contributions, the home, the division of property and how life is organised after the break-up. When that agreement is not possible, divorce on the ground of irretrievable breakdown leads to the same objective, ending the marriage.
I help you choose the most suitable route, taking into account urgency, the level of conflict, the presence of children, the financial situation and what is at stake in terms of property. The aim is to build a clear, protective and realistic framework, whether the solution is negotiated or decided by the court.

Every situation is unique, but certain questions come up in almost every separation case.
Divorce by mutual consent You agree on what each party is asking for and you want a clear, complete framework approved in a judgment. Divorce on the ground of irretrievable breakdown A divorce obtained once the statutory periods have elapsed (one year or six months of separation). Measures deemed urgent Before the Family Court, certain applications are treated as urgent and heard quickly: separate residence, what happens to the home, first arrangements for the children, responsibility for debts from the date of separation. Children in the separation Parental authority, residence, maintenance contributions, extraordinary expenses, and contact rights for grandparents and siblings from a previous relationship. After the divorce: the property The liquidation and division of the joint estate is prepared from the very start of the divorce proceedings.
